GENERAL LIABILITIES & CONDITIONS OF REPAIR

1.The Company hereby warrants that the Products supplied are free from defects in workmanship and/or materials at the time that the risk passes to the Customer and that for a period of three years for all Newtons4th branded items ( except N4A Programable Sources at one year) from such time the Company will repair or replace any affected Product provided always that the Company’s liability under this warranty shall be limited to the repair or replacement of affected Products and is conditional upon the Customer. All other non Newtons4th branded accessories are subject to their own manufacturer’s warranty.
1.1. Notifying the Company promptly of any such defect and in any event within such period of three years.
1.2. Returning to the Company the affected Products properly and adequately packed carriage or post-paid within fourteen days of such notification.
1.3. Having ensured that the Products have not been tampered with modified or altered in any way;
1.4. Ensuring that the Products are protected from harm or otherwise properly cared for and are retained in the possession of the Purchaser

2.The warranty contained in paragraph 1. of this Condition is given in lieu of and shall be deemed to exclude all other warranties and conditions whether express or implied and whether arising by common law statute or otherwise other than relating to title to the Products. In particular, but without limitation to the foregoing the Company shall not be liable for the failure of any of the Products supplied to be fit for any particular purpose for which they are required.

3.The Company shall not be liable for any loss injury or damage of any nature whatsoever (other than for death or personal injury resulting from the gross negligence of the Company) whether direct or consequential arising out of or in connection with any Products supplied

4.Without prejudice to the generality of the foregoing nothing contained in these conditions shall operate to exclude or restrict liability for breach of any obligation arising from Sections 13, 14 or 15 of the Sale of Goods Act 1979 (as amended by the Sale and Supply of Goods Act 1994) or the Supply of Goods and Services Act 1982 as against the Customer if he is dealing as a consumer as construed in accordance with Part 1 of the Unfair Contract Terms Act 1977.

5. The Customer shall not rely upon any representation concerning any Products supplied unless the same shall have been made by the Company in writing.

6. In the event that the Company fails or is unable to deliver the Products in accordance with the contract with the Customer by reason of circumstances beyond its control (including without prejudice to the generality of the foregoing force majeure war strike lock-out sit-in trade dispute flood accident to premises or plant or machinery or shortage of any labour) the Company shall be entitled to cancel or rescind the contract without liability of whatsoever nature for loss or damage resulting therefrom.

7.The price at which the Company agrees to supply the Products to the Customer is based on: -
7.1. The warranties given and accepted; and
7.2. The extensions and restrictions of liability imposed.

8.The Company is prepared to negotiate a different price if the Customer requires any variation of such warranties or extension of the liabilities accepted by the Company.

9. The purchaser agrees that should a product be returned for service or repair and no fault is found, that a service/inspection charge may be payable.

10. Upon receipt, if the item is within the warranty period, an initial assessment will be made to determine if the fault is due to faulty components, materials, or manufacturing. Accident damage, user error and use, accidental or otherwise outside of published specifications shall render the warranty null and void.

If a warranty repair is carried out and the product is less than 12 months old, the company will cover the costs of return carriage with the exception of any import/export fees applicable.

If a warranty repair is carried out and the product is over 12 months old, the customer will cover all carriage costs.

11. Unless the fault is purely cosmetic, i.e., a cracked window or broken handle, we will always subject the instrument to our wideband calibration after the repair is complete as part of the repair inspection process.

12. Before commencing any repair work, an official quotation will be supplied, repairs will not commence until acceptance of the quote & the receipt of a valid purchase order is received.

13. If the instrument is within 15 months of the original supply date, the calibration will be provided FOC as part of the warranty repair.

14. If the instrument is older than 15 months, then the calibration will be charged for, even on a warranty repair between 15 months and the 36 months of the original warranty as stated in the user manual. If the customer specifies that a calibration is not required, the charge will be removed, and no calibration certificate will be supplied, unless the nature of the repair deems that a calibration is required.

15. Any in warranty repair will subsequently be warranted until the end of the original warranty period.
All repairs carried out beyond the original warranty period shall be warranted for a period 6 months only.

16. Any instrument or accessory returned for repair found not to exhibit any fault will be charged an investigation fee of £100.

17. The minimum labour time for a repair is 1 hour.

18. If the packaging used to return any instrument or accessory is deemed inadequate to fully protect the item for its return carriage, we reserve the right to supply and charge for new protective packaging.

19. Wear and Tear items exclusions. Power source capacitors, on-board back up lithium metal batteries, and lithium ion main power batteries are deemed to be a serviceable item, as such they are expected to require replacement over the expected life span of any N4L product having such a device included in its design. Therefore, these items are expressly excluded from any warranty cover except from that through the initial warranty period offered in a new instrument purchase.
